What is Social Security Disability Insurance (SSDI)?

The Social Security Disability Insurance (SSDI) is a government program that helps people and some family members if the person cannot work for a prolonged period.

It is regulated by the Social Security Administration (SSA), and has strict eligibility requirements.

SSDI payments vary from one year to another according to the cost of living adjustments and are based on the average income that the person has generated during their working life.

You could have the right to receive SSDI if you meet all the following requirements:
Be under 65 years
Having legally worked and paid your taxes for 10 years in the US
Have a disability that prevents you from working

The SSDI Process

1. Application

In this first step, your medical limitations, symptoms, medical history and labor history are reported. The SSA takes this information into account to determine if you are disabled and if your state prevents you from working for the next 12 months. The SSA takes between 3 months to over a year to review its application. Unfortunately, approximately two thirds of the initial applications are denied. But don’t worry:

2. Reconsideration

If your application was not approved, you still have another chance. In this step, the SSA is requested to review your application again in case an error has been made, and the additional information required by the SSA is provided. The reconsideration takes 3 to 6 more months.

The SSA could then approve your monthly payments for disability.
If your case is denied, our office requests a hearing before an Administrative Law Judge.

3. Appeal Hearing

In this last step, you appear before a judge who works for the SSA. Take in consideration that the SSA can take up to a year to schedule this audience. At the hearing, the judge examines the evidence and determines if you have the right to disability benefits. The Application
